The Triple Lindy from a Divorce Perspective
As moms and dads everywhere pop the champagne as the kids head back to school, it is important to make sure that your divorce terms are as up to date as the new shoes you inevitably had to buy because all the cool kids are wearing them. Parenting Time: Is your current parenting time in line with your child's new school schedule? New school year often means new activities with different start and stop times then were contemplated in your Allocation Judgment. If Junior is now on the football team, can you still start your parenting time at 3:30 or on Friday night? Does after school or Saturday practice interfere with your parenting time schedule? A formal modification of parenting time may be needed to address these recent changes--especially if you Allocation Judgment was entered when your children were much younger. Educational Payments: Does your Marital Settlement Agreement address the allocation of school registration fees? Book Fees? Athletic costs? Has the other party reimbursed you their required share of the school expenses that you of course paid in full at registration? What are your options if your ex decides that since they don't agree with Junior playing football, they won't agree to contribute anything towards helmets, cleats or the jock strap? Child Support: Even though this is a year round issue, if you are contemplating going back to court to change the parenting time and compel payment of educational expenses, perhaps it might be a good time to review whether there has been a substantial change in circumstances warranting a modification of child support.
